SPH Terms of Service

Web Hosting Terms of Service This document is pursuant to the Digibase Operations ("Digibase") general Terms of Service located at http://digibase.ca/?p=Terms_Of_Service and is entered into upon application for web hosting services ("hosting services").

1. Non-Commercial Service

In use of hosting services, The User acknowledges that Digibase is not a public and/or commercial web hosting operation. Digibase does not guarentee, implied or otherwise, hosting services outside of explicit agreements. Digibase provides hosting for special projects or web sites that have specal requirements not fulfilled by commercial providers.

1a. Commerce and marketting

As Digibase supplies this service as a non-commercial service and as a non-commercial organization in itself, utilizing hosting services to host business websites such as e-commerce, advertising and other such commercial venues is strictly prohibited.

2. Application

The User must submit a formal application to Digibase for web hosting. All applications are reveiwed and may be declined for any reason whatsoever. Any information provided on applications must be provided in english and be most correct.

3. Domain Names and Subdomains

Domains or subdomains are a convention of the internet that provides easy to remember addresses for resources, such addresses are provided by DNS (“Domain Name System”).

3a. Domain Names

The User is soley responsible for registering domain names for use with web hosting. Digibase may provide information for third party domain name registrars however is not responsible for the service that such registration services provide.

3b. Subdomains provided by Digibase

Digibase may at its discretion if The User is unable to register their own domain, provide The User a subdomain under its domain name. Digibase maintains ownership and registration of such subdomains at all times. Digibase may deny requests for subdomains at its sole discretion. It is advised subdomains do not appear to be representing of Digibase or any of its officials, computer systems, subsidaries or associates.

4. Knowledge and Competence

Upon application, The User warrants that they have sufficient knowledge to maintain and operate their website. This knowledge includes but is not limited to, File Transfer Protocol (FTP), web design, database management, web standards, and other such concepts. Any support provided to users will assume familiarity in regards to these concepts.

5. Content and Copyright

Content posted to websites hosted is the sole responsibility of The User, in addition must acknowledge copyright law in their region. Digibase disclaims all responsibilities for copyright infringement of user websites it hosts. The User upon posting content is providing Digibase immunity from any and all legal suits and prosecution as a result of their content to the maximum allowance by the law.

6.Third Party Software

Scripts, programs and other such software is often a valuable addition to a website. However such software must be properly secured, configured and installed. Digibase reserves the right to check software installed on user sites. Digibase does not support third party software and as such users are instructed to contact the software developer or vendor for support.

6a. Forbidden Software

Various software that may not be uploaded and/or executed on Digibase systems includes, but is not limited to:

  • Proxy scripts
  • IRC Bots and/or CGI IRC scripts
  • Unauthorised network utility scripts
  • Mass-mailers
  • Remote shells

7. Network Traffic

Some software on user accounts initiates outgoing network traffic for purposes such as domain name resolution, self-update mechanisms, retrieving remote data and so on. Software is prohibited from performing or attempting to perform malicious activities via the network, such activities include, but are not limited to:

  • Repeatedly accessing resources without valid reason
  • Repeatedly transmitting any packet or group of packets in an automated manner.
  • Forging any part of a header or address
  • Relaying any part of a connection (Proxy)
  • Probing any network or internet host
  • Crafting any low level packet
